{"id":3772,"date":"2012-12-28T00:00:00","date_gmt":"2012-12-28T00:00:00","guid":{"rendered":"https:\/\/training.washingtonautismadvocacy.org\/the-epsdt-benefit\/"},"modified":"2019-08-02T23:48:52","modified_gmt":"2019-08-02T23:48:52","slug":"the-epsdt-benefit","status":"publish","type":"page","link":"https:\/\/washingtonautismalliance.org\/training\/the-epsdt-benefit\/","title":{"rendered":"The EPSDT Benefit"},"content":{"rendered":"<h3><strong>The Early Periodic Screening, Diagnosis, and Treatment (EPSDT) Benefit<\/strong><\/h3>\n<p><em><strong>Washington Autism Alliance &amp; Advocacy<\/strong><\/em> and&nbsp;<em><strong>Northwest Justice Project<\/strong><\/em> filed a lawsuit in U.S. District Court on April 26, 2012 regarding HCA\u2019s lack of coverage for ABA therapy as part of the&nbsp;&nbsp;EPSDT obligation for children with autism. HCA had previously settled a lawsuit regarding its public employees health plan. HCA agreed to settle the lawsuit for Medicaid children and developed an ABA program for low-income children.<\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif;\">The<\/span><strong><span style=\"font-family: Arial,Helvetica,sans-serif;\"><span style=\"color: #800080;\"> Early Periodic Screening, Diagnosis, and Treatment (EPSDT) <\/span><\/span><\/strong><span style=\"font-family: Arial,Helvetica,sans-serif;\"><span style=\"color: #800080;\"><span style=\"color: #000000;\">Program<\/span>&nbsp;<\/span><\/span><span style=\"font-family: Arial,Helvetica,sans-serif; color: #000000;\">is a&nbsp;<strong>required benefit<\/strong><\/span> for all \u201ccategorically needy\u201d and \u201cMedicaid eligible\u201d children 3-21 years old (must be income eligible, receive Supplemental Security Income, or receive federal foster care or&nbsp;adoption assistance).<\/p>\n<p>EPSDT\u2019s rules reflect the greater health needs of low-income children, as well as children whose&nbsp;special health needs qualify them for assistance. It\u2019s required in every state and is designed to improve the health of eligible children, by financing appropriate and necessary pediatric services.<\/p>\n<p><em>***We need your input on the extremely fragmented access to developmental pediatricians, neuropsychologists, Speech, language &amp; communication specialists with bonafide experience with autism, occupational therapists and ABA providers. &nbsp;Please call our office and share any information that reflects unreasonable distance&nbsp;you have to travel to access care OR if there are NO in network providers currently available to your child<\/em><\/p>\n<h3><strong>THE&nbsp;EPSDT&nbsp;BENEFIT<\/strong><\/h3>\n<p><span style=\"color: #ff0000;\"><strong>These services include:<\/strong><\/span><\/p>\n<p>\u2022&nbsp;Medical care or any other type of remedial care recognized under state law or furnished by licensed practitioners within the scope of&nbsp;their practice, as defined by state law<span style=\"color: #000000;\"> (<\/span><span style=\"color: #ff0000;\"><strong><span style=\"color: #000000;\"><span style=\"text-decoration: underline;\">this includes psychosocial treatments and other structured behavior treatments such as Applied Behavior Analysis<\/span>-WAAA reached a settlement with Medicaid to add ABA as a benefit under EPSDT.<\/span><br \/>\n<\/strong><\/span><\/p>\n<p>\u2022&nbsp;Home-based care<\/p>\n<p>\u2022&nbsp;Dental services<\/p>\n<p>\u2022&nbsp;Clinic services<\/p>\n<p>\u2022&nbsp;Other diagnostic, screening, preventive, and rehabilitative services, including any medical or remedial service (provided in a facility,&nbsp;a home, or other setting) recommended by a physician or other licensed practitione<span style=\"color: #000000;\">r <\/span><span style=\"color: #ff0000;\"><span style=\"color: #000000;\">for the<strong> <span style=\"text-decoration: underline;\">maximum reduction of physical or mental&nbsp;disability<\/span><\/strong> and restoration of an individual to the <strong><span style=\"text-decoration: underline;\">best possible functional level<\/span><\/strong><\/span><\/span><span style=\"color: #000000;\"><strong><span style=\"text-decoration: underline;\">.<\/span><\/strong><\/span><\/p>\n<p>\u2022&nbsp;Physician services<\/p>\n<p>\u2022&nbsp;Hospital services (outpatient and inpatient)<\/p>\n<p>\u2022&nbsp;Federal qualified health center services<\/p>\n<p>\u2022&nbsp;Rural health clinic services<\/p>\n<p>\u2022&nbsp;Case management<\/p>\n<p>\u2022 Personal care services<\/p>\n<p>\u2022&nbsp;Any other medical or remedial care recognized by the Secretary of Health and Human Services<\/p>\n<p>\u201cPreventive\u201d standard of medical necessity:&nbsp;recognized in agency implementing guidelines and a long line of judicial decisions, which&nbsp;recognizes the prevention of disabilities as the standard of coverage and emphasizes attainment of growth and development.<\/p>\n<p>Necessary health care diagnosis services, treatment, and other measures classified as medical assistance&nbsp;to&nbsp;<span style=\"color: #ff0000;\"><span style=\"color: #000000;\">correct or ameliorate&nbsp;defects and physical and neurological chronic health conditions discovered by screening services, <\/span>whether or not such services are covered under the state&nbsp;medical assistance plan.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Courts&nbsp;have consistently determined evidence based treatment for autism should be covered by EPSDT<\/strong><\/span><strong>. <\/strong>Centers for Medicare and Medicaid Services (CMS), however, took the position that ALL autism related treatments are covered under IDEA for school aged children (3-21). This position was challenged in court over&nbsp;<a href=\"..\/wp-content\/uploads\/epsdt_aba.pdf\"><span style=\"color: #ff0000;\">EPSDT coverage of (ABA)<\/span><\/a><span style=\"color: #ff0000;\">,<\/span>CMS lost.<\/p>\n<p>CMS appealed the decision in the 6th Circuit court &amp; lost. &nbsp;The precedence has been set that ABA\/Behavioral therapies and Neurodevelopmental therapies SHOULD be covered through EPSDT, even in Washington state! &nbsp;If your child has been denied, visit our&nbsp;<strong><a
