The APPLICANT shall indemnify and hold the WASHINGTON AUTISM ALLIANCE, City of Kirkland, and its agents, employees and/or officers, harmless from and shall process and defend at its own expense any and all claims, demands, suits, at law or equity, actions, penalties, loss, damages, or costs, of whatsoever kind or nature, brought against the WASHINGTON AUTISM ALLIANCE, City of Kirkland, arising out of, or in connection with, or incident to, the execution of this Agreement and/or APPLICANT’S performance or failure to perform any aspect of this Agreement; provided, however, that if such claims are caused by or result from the concurrent negligence of the WASHINGTON AUTISM ALLIANCE, City of Kirkland, its agents, employees and/or officers, this indemnity provision shall be valid and enforceable only to the extent of the negligence of the APPLICANT; and provided further, that nothing herein shall require the APPLICANT to hold harmless or defend the WASHINGTON AUTISM ALLIANCE, City of Kirkland, its agents, employees, and/or officers for damages or loss caused by the sole negligence of WASHINGTON AUTISM ALLIANCE, City of Kirkland. The APPLICANT expressly agrees that the indemnification provided herein constitutes the contractor’s waiver of immunity under Title 51 R.C.W., for the purposes of the Agreement. This waiver has been mutually accepted by both the parties. The provisions of this section shall survive the expiration or termination of this Agreement. Applicant has read and understands the Application and Rules & Regulations, page 2, and will abide by them throughout their association with the 2026 Day Out for Autism.  It is understood that the Washington Autism Alliance and Advocacy reserves the right to close, without refund, any participant not complying with these regulations.

Payment for the booth space can be made with Credit Card (Stripe) or PayPal.  Payments due at the time of application.  In the event that all booth spaces are taken, you will be notified as such and your credit card will not be processed or your check will be returned to you.
